1 Acceptance of Terms

By connecting your wallet and using Hedges Capital, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old to use our services.

2 Description of Services

Hedges Capital is a decentralized prize savings protocol that allows users to:

• Deposit stablecoin assets into yield-generating smart contracts
• Receive prize tickets proportional to their deposits
• Participate in prize draws funded by yield
• Withdraw their principal at any time

3 Eligibility and Restrictions

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts. You represent that you are not located in, or a citizen or resident of, any jurisdiction where the use of our services would be illegal or restricted.

3.2 Prohibited Jurisdictions

Our services are not available to users in the following jurisdictions: United States, China, North Korea, Iran, Syria, Cuba, and any other jurisdiction where cryptocurrency services are prohibited.

3.3 Prohibited Activities

You agree not to:

• Use the platform for money laundering or illicit activities
• Attempt to manipulate prize draws or exploit vulnerabilities
• Use bots or automated systems without authorization
• Interfere with the platform's operation or security
• Violate any applicable laws or regulations

4 User Responsibilities

4.1 Wallet Security

You are solely responsible for maintaining the security of your wallet and private keys. We cannot recover lost or stolen funds. Never share your private keys or seed phrases with anyone.

4.2 Transaction Verification

You are responsible for verifying all transaction details before approval. Blockchain transactions are irreversible and cannot be refunded once confirmed.

4.3 Compliance

You are responsible for complying with all applicable tax laws and reporting requirements in your jurisdiction.

5 Risks and Disclaimers

5.1 Smart Contract Risk

Our platform operates through smart contracts on public blockchains. While we conduct thorough audits, smart contracts may contain bugs or vulnerabilities that could result in loss of funds.

5.2 Market Risk

Cryptocurrency and DeFi markets are volatile. The value of assets and yields can fluctuate significantly. Past performance does not guarantee future results.

5.3 Regulatory Risk

The regulatory landscape for cryptocurrency is evolving. Future regulations may impact our ability to provide services or your ability to access your funds.

5.4 No Guarantees

We do not guarantee yields, prize amounts, or platform availability. Prize pools are dependent on yield generation and may vary.

6 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEDGES CAPITAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability to you for any claims arising from these Terms or your use of the platform shall not exceed the amount of fees you paid to us in the 12 months preceding the claim.

7 Indemnification

You agree to indemnify and hold harmless Hedges Capital and its affiliates from any claims, damages, losses, or expenses arising from your use of the platform, violation of these Terms, or infringement of any rights of third parties.

8 Intellectual Property

All content, trademarks, and intellectual property on our platform are owned by Hedges Capital or our licensors. You may not use our intellectual property without prior written consent.

9 Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our platform or via email. Continued use of our services after changes constitutes acceptance of the modified Terms.

10 Termination

We may suspend or terminate your access to our platform at any time for violation of these Terms or applicable laws. You may stop using our services at any time.

11 Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration shall be conducted in English and the seat of arbitration shall be Singapore.

12 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

13 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
